Information technology managers are crucial to business operations today. The success of a company depends on its ability to remain abreast of cutting edge IT developments and to utilize the technology to its advantage. Given the scope of today’s international marketplace, many businesses are connected as affiliates, subsidiaries, parent companies or branch offices with business in foreign countries. As business needs change and expand, employees from foreign offices, including IT managers, general managers and executives, sales managers and marketing managers, are frequently transferred to one of the company’s U.S. operations.
When an IT manager is transferred from a foreign company to one of its “qualifying organizations” within the United States, the employee may be eligible for an L-1A work visa. The skilled employment visa attorneys at The Shapiro Law Group have considerable experience helping businesses meet their employment needs by hiring and transferring foreign employees while complying with U.S. immigration laws and regulations. Our knowledgeable business visa attorneys are familiar with the requirements and petition process of the L-1A visa as it pertains to IT managers, as well as other managers and executives.
Unless the employer has obtained a blanket L-1 authorization, the transferred employee must have worked for a parent, subsidiary, affiliate or branch office of the U.S. Company for at least one continuous year within the previous three years and be employed in a managerial or executive capacity.
The employer must be a parent company, branch office, subsidiary or affiliate of the foreign company from which the employee is transferred and be doing business as an employer in the United States and at least one other country for the duration of the transferred employee’s stay in the United States under the L-1A visa.
A manager or executive is eligible to work in the United States pursuant to a valid L1A visa for up to three years, and up to seven years pursuant to an L-1A transfer visa. Spouses of general managers and executives that obtain an L-1A work visa are eligible for employment authorization pursuant to an L-2 employment visa.
