Qualifications of IT Manager and the Employer

Unless the employer has obtained a blanket L-1 authorization, the transferred employee must have worked for a parent, subsidiary, affiliate or branch office of the U.S. Company for at least one continuous year within the previous three years and be employed in a managerial or executive capacity.

The employer must be a parent company, branch office, subsidiary or affiliate of the foreign company from which the employee is transferred and be doing business as an employer in the United States and at least one other country for the duration of the transferred employee’s stay in the United States under the L-1A visa.

Authorization Period

A manager or executive is eligible to work in the United States pursuant to a valid L1A visa for up to three years, and up to seven years pursuant to an L-1A transfer visa.  Spouses of general managers and executives that obtain an L-1A work visa are eligible for employment authorization pursuant to an L-2 employment visa.
