According to recent reports from the U.S. Citizenship and Immigration Services (USCIS), more than 90 percent of individual Form I-526 visa petitions are currently based on foreign citizen investment in so-called “Regional Center” commercial enterprises.
These enterprises fall within “targeted employment areas” (as defined by regulation) and are certified by the USCIS to meet the purposes of the EB-5 pilot visa program.
The Pilot Program was created by Congress in 1993 as a temporary program allowing qualified EB-5 investments to be made through the USCIS designated Regional Centers.
Each year, there are 3,000 visas set aside for the Pilot Program that come from the 10,000 visas allocated in total to the EB-5 visa program.
This program is so popular and so effective that Sen. Patrick Leahy (D-Vt) has introduced a bill entitled “The Creating American Jobs Through Foreign Capital Investment Act.” The bill is intended to make the program permanent and is expected to receive bipartisan support.
