Travel Risk for Green Card Applicants

Summer is vacation and travel time for many families, but it can present dangers to those applying for permanent resident status or any adjustment to immigration status under Form I-485.

If you leave the country while your I-485 application is pending, your petition can be deemed abandoned, and under some circumstances, can potentially jeopardize your ability to re-enter the country legally.

At the very least, the paper work that you filed will have to be reworked and you will have to submit additional fees for a new application upon your return.

Thus, it is probably best to postpone travel plans outside the country while an application to adjust status is pending, but those who have to travel home for an emergency or feel the need to visit family should file the I-131 Advance Parole document.
