At the start of this year, the Obama administration announced that it would increase the number of employer I-9 audits while establishing a new Employment Compliance Inspection Center as part of the Department of Homeland Security.
This is a further commitment to and amplification of the administration’s policy of targeting employers through I-9 audits rather than conducting workplace raids aimed at workers. The consequences can be serious for employers, who have not only incurred some hefty six-figure and seven-figure fines, but in some cases, have been debarred from government contracting.
In fact, the Secretary of Homeland Security Janet Napolitano has asserted that the administration has conducted more employer audits and issued more debarments in two years than the prior administration did in eight years.
A large number of additional enforcement officers are slated to start work this year, so employers should expect even more I-9 scrutiny in 2011.
