On Nov. 23, 2010, the U.S. Citizenship and Immigration Services (“USCIS”) introduced a new standardized form for requesting waiver of (or legal excuse from) fees charged for immigration benefit processing.
On the same day that the USCIS fee hikes took place, raising fees by an average of roughly 10 percent, the new forms for waiver (legal excuse) identified the clear requirements and avenues for obtaining a waiver of fees.
In the past, different forms were used for different purposes at various offices, but now one standardized form provides sufficient information on the evidence or documentation needed to obtain fee waivers. In some cases, evidence can be incorporated by reference, as when an applicant can show that he or she is receiving a means-tested benefit.
The new Form I-912 is expected to simplify the application process for waivers and expedite processing times. Those who wish to offer comments on the form or on the policy for reviewing fee waiver requests may go to the “outreach” section of the USCIS Website.
